1. Acceptance of Terms
By accessing or using Writomize ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes constitutes acceptance.
2. Description of Service
Writomize provides an AI-powered platform to create KDP-ready books (e.g., coloring books, activity books). Features include generation of interior and cover artwork, PDF export, subscription-based credits, and related tools. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.
3. Account and Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. You must provide accurate registration information and notify us promptly of any unauthorized use.
4. Use of Generated Content
Subject to your subscription and our acceptable use policy, you may use content generated through the Service for commercial purposes (e.g., publishing on Amazon KDP) in accordance with your plan. You may not use the Service to generate illegal, infringing, or harmful content. We do not claim ownership of content you create using the Service, but we may use anonymized or aggregated data to improve the Service as described in our Privacy Policy.
5. Payments and Refunds
Subscription and one-time purchases are billed as described at checkout. Fees are in U.S. dollars unless otherwise stated. Refunds are handled in accordance with our refund policy and applicable law; subscription cancellations take effect at the end of the current billing period. Chargebacks may result in account suspension.
6. Intellectual Property
Writomize, its branding, and the technology underlying the Service are owned by us or our licensors. You may not copy, reverse-engineer, or misuse our systems. Your generated content remains yours subject to these terms and our acceptable use guidelines.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT CONTENT GENERATED WILL BE FREE OF ERRORS, SUITABLE FOR ANY PARTICULAR USE, OR COMPLIANT WITH THIRD-PARTY PLATFORM RULES (E.G., AMAZON KDP). YOU USE THE SERVICE AT YOUR OWN RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WRITOMIZE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Termination
We may suspend or terminate your account and access to the Service for breach of these terms, fraud, or any reason with notice where required. You may cancel your account at any time. Upon termination, your right to use the Service ceases; we may retain data as described in our Privacy Policy and for legal compliance.
10. Governing Law and Disputes
These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of laws. Any disputes shall be resolved in the courts of Delaware, except where prohibited. If any provision is held invalid, the remainder of these terms remains in effect.
